DentalVerify — Notice of Privacy Practices
This notice describes how medical and dental information about you may be used and disclosed and how you can get access to this information. Please review it carefully.
1. Our Legal Duty
DentalVerify and Dr. Patrick Whilby, DDS (Texas Dental License #32494) are required by federal law (HIPAA/HITECH) and Texas law to maintain the privacy and security of your Protected Health Information (PHI). We are required to provide you with this notice of our legal duties and privacy practices.
2. How We Use & Disclose Your Health Information
To Provide Review Services
We use your uploaded name, contact details, medical history, and X-rays strictly to perform the requested teledentistry review.
Business Associates
We may share PHI with trusted HIPAA-compliant vendors (e.g., encrypted form processors, secure cloud storage) who sign formal Business Associate Agreements (BAAs) committing to identical privacy protections.
As Required by Law
We may disclose PHI if required by court order, subpoena, or statutory board reporting mandates.
No Sale of Data: DentalVerify never sells, rents, or trades your personal health data, email addresses, or dental records to third-party advertisers or marketers.
3. Your Privacy Rights
Under HIPAA, you have the right to:
- Inspect and receive a digital copy of your complete dental file and video review.
- Request corrections to incorrect demographic or health details.
- Request a restriction on certain uses or disclosures of your health data.
- Receive notification in the event of an unauthorized security breach affecting your unencrypted PHI.
4. Record Retention
In accordance with Texas State Board of Dental Examiners Rule §108.8, your digital dental records, video reviews, and transaction details will be retained securely for at least five (5) years from the date of service (or longer for minor patients).
5. Complaints & Board Notice
If you believe your privacy rights have been violated, you may file a written complaint with DentalVerify at support@dentalverify.co or directly with the Texas State Board of Dental Examiners (TSBDE). No retaliation will occur for filing a complaint.
